Please be advised that Public Hearings of Sarnia City Council will be held on Monday, September 9, at 1:00 pm to consider the planning application for the property listed below and as shown on the Area Map.                                                                           

  1. Official Plan Amendment No. 06-2024 is to amend the City of Sarnia Official Plan to add site and area-specific policies for 530 & 540 Exmouth Street regarding the maximum permitted height for high-rise residential buildings, as well as to create site and area-specific policies for the minimum required amount of at-grade gross floor area for active, non-residential land uses where residential development is proposed within the Mixed Use Corridor I Designation. Per Section 5.1.5.3(a) of the Official Plan, a high-rise building is permitted to be a maximum of 12 storeys or 45 metres, whichever is less. Additionally, Section 5.3.2.3 of the Official Plan specifies that within the Mixed Use Corridor I Designation, where residential development is proposed, it is a requirement of the plan that all buildings shall incorporate a minimum of 50% of at grade gross floor area to active, non-residential land uses.
  2. Zoning By-law Amendment No. 2-2024-85 of 2002 is to amend the City of Sarnia Zoning By-law 85 of 2002, as amended, to create site-specific General Commercial 1 zones on the subject lands, to permit Apartment Dwellings and Multiple Use Apartment Dwellings and establish site-specific regulations related to:
  • Lot Coverage
  • Building Height
  • Required Parking
  • Visitor Parking
  • Tower Face Separation Distance
  • Amenity Space
  • Minimum First Floor Height

The proposed amendment would facilitate the development of two 23-storey mixed use apartment buildings on the subject lands.

If approved, developments on any of the above-noted lands would proceed in accordance with a required Site Plan Control Agreement and required Building Permits.

Planning Act Appeal Information

If a person or public body would otherwise have an ability to appeal the decision of the City of Sarnia to the Ontario Land Tribunal, but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Sarnia before the Zoning By-law is passed the person or public body is not entitled to appeal the decision of the Council of the Corporation of the City of Sarnia to the Ontario Land Tribunal (OLT) and may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal (OLT) unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
