NOTICE OF PUBLIC MEETING PURSUANT TO SECTIONS 34(10.4) AND 34(12) OF THE PLANNING ACT, R.S.O. 1990, AS AMENDED, IN RESPECT TO A PROPOSED AMENDMENT TO THE ZONING BY-LAW
- Rezoning Application 10-2024-85 of 2002
THE LAND SUBJECT of these applications is located along the northern portion of Michigan Avenue, east of Murphy Road and west of Blackwell Road and is addressed municipally as 1258 Michigan Avenue. It is approximately 1.06 Ha (2.64 acres) in size with approximately 29.0 metres of frontage along Michigan Avenue, an arterial County Road (County Road 19). An existing two-storey building recently used as a sleep disorder clinic occupies the subject lands.
THE PURPOSE AND EFFECT of the proposed application is to amend the City of Sarnia Zoning By-law No. 85 of 2002, to re-zone the subject lands to a site specific Urban Residential 4-28 (UR4-28) zone, containing site specific regulations for side yard setbacks and all other existing site conditions for Apartment Dwellings as set out in Section 10.2 of the Zoning By-law.
These proposed changes are to permit an apartment dwelling use as a primary permitted use, which was an existing legal non-confirming use when Zoning By-law No. 85 of 2002 was adopted. The Owner is proposing to convert the existing two-storey building on the subject lands to contain eight (8) proposed apartment dwelling units.

PURSUANT TO SECTION 34 (12) OF THE PLANNING ACT, R.S.O. 1990, AS AMENDED, IN RESPECT TO A PROPOSED NEW CITY-WIDE COMPREHENSIVE ZONING BY-LAW
2. New Comprehensive Zoning By-law
The City of Sarnia has prepared a second draft of the new Comprehensive Zoning By-law.
The purpose of the application is to repeal and replace the current Zoning By-Law 85 of 2002 with the proposed new City-wide Zoning By-law. A Zoning By-Law is a tool used to implement the policies of the newly approved City of Sarnia Official Plan. This is a key document which controls the use of land, buildings, and structures, across all property within the City. The Zoning By-law informs where buildings may locate on a property, how they can be used, and what form they can take (e.g., detached house, mid-rise, etc.).
All comments submitted to date will be considered by staff. There is no requirement to resubmit comments provided prior to the previously scheduled Public Meeting.
All information including opinions, studies, presentations, reports, are considered part of the public record and may be posted on the City of Sarnia website. Draft two of the new Zoning By-law is available on Speak Up Sarnia (https://www.speakupsarnia.ca/zoning). No key map is provided in this notice, as this new by-law would apply City-wide.

3. Official Plan Amendment No. 9 and Rezoning Application 7-2022-85 of 2002
THE LAND SUBJECT to the proposed applications are located at the east end of Pamela Court bounded by Hillcrest Drive on the east, Hillcrest-Nesbit Drive to the north and single detached dwellings along Lakeshore Road to the south. The subject lands have a lot area of approximately 1.76 hectares (4.35 acres).
THE PURPOSE AND EFFECT of the proposed applications are:
Application for Official Plan Amendment #9 (OPA#9)
Application to amend the City of Sarnia Official Plan to:
- add a site and area-specific policy to permit the creation of 6 new residential lots in a “Natural Area ‘Type B’; or
- redesignate a defined area of the lands from Environment Protection (in the approved OP) to Exiting Neighbourhood
Application for Zoning By-law Amendment No. 7-2022-85 of 2002
Application to amend the City of Sarnia Zoning By-law 85 of 2002 to rezone a portion of the subject lands to an Environmental Protection Area 1 (EPA1) to provide protection for the Natural Area and permit the creation of 6 new residential lots.
If approved, all new developments would proceed in accordance with a Draft Plan of Subdivision. The plan submitted with these applications shows the site’s configuration.

Planning Act Appeal Information
If a person or public body would otherwise have an ability to appeal the decision of the City of Sarnia to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Sarnia before the Zoning By-law Amendments are adopted, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Sarnia before the Zoning By-law Amendments are passed the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
