Please be advised that a public meeting to consider the following application will be held by Sarnia City Council in the Council Chambers at City Hall on: Monday, February 10, 2020 at 4:00 p.m.

Persons wishing to speak to these applications are requested to notify the City Clerk on or before noon Wednesday, February 5, 2020 in order to be placed on the agenda, although anyone in attendance will be given an opportunity to address Council on this matter.

Rezoning Application 3-2020-85 of 2002 is a City-initiated general amendment to the City’s Zoning By-law No. 85 of 2002 that would define payday loan establishments and permit them in all Downtown 1 (D1), Commercial Centre 1 (CC1), General Commercial 1 (GC1) and General Commercial 2 (GC2) Zones of the City (See Area Map).

The new definition proposed for a Payday Loan Establishment includes the following “means the use of a building in which personal loans are provided to consumers and which is regulated under the Payday Loans Act and shall not include a financial institution”.

A new licensing by-law for payday loan establishments will also be considered by Council on February 10, 2020. This by-law will require operators to obtain an annual licence from the City. It would also permit a maximum of seven payday loan establishments in the City and require the use to be located a minimum of 500 metres from another payday loan establishment. Existing businesses will be considered legal non-conforming, provided they obtain a licence from the City.

PLANNING ACT INFORMATION FOR REZONINGS

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Council of the Corporation of the City of Sarnia before the by-law is passed, the person or public body:

  1. is not entitled to appeal the decision of the Council of the Corporation of the City of Sarnia to the Local Planning Appeal Tribunal (LPAT); and
  2. may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal (LPAT) unless, in the opinion of the Board, there are reasonable grounds to do so.
