Zoning By-law Amendment (ZBA) No. 13-2021-85 of 2002
This is an application submitted by Ken Maaten, proposing to change the zoning of the subject lands from an “Interim Use 1 (IU1) Zone” to a “Light Industrial 1-3 (LI1-3) Zone”, to permit the Owner (Procor) to expand its rail car maintenance operation onto the northern portion of its lands.

1299-1331 Murphy Road The applications submitted byHarry Patrinos – Saint Demetrios Greek Orthodox Church (Agent – Wellington Ridge Developments- Heather Martin) are:

Official Plan Amendment (OPA # 35) To change the designation of the subject lands from Urban Residential to Apartment Residential; and

Zoning By-law Amendment
No. 08-2021-85 of 2002
To change the zoning of the subject lands from “Urban Residential 1 (UR1)” to a site-specific “Urban Residential 5 (UR5)’ Zone, with special zone provisions that would permit the proposed development.

The above-noted applications are to permit the development of a six-storey, 46-unit residential apartment building on the site. The existing Greek Orthodox Church and day care centre uses will remain.

The public meeting scheduled for Monday, October 25, 2021, was deferred until a staff recommendation was prepared.

If the above-noted applications were approved, the developments would proceed in accordance with approved Site Plan Development Control Agreements.

Appeal Information If a person or public body would otherwise have an ability to appeal the decision of the City of Sarnia or County of Lambton to the Ontario Land  Tribunal, but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Sarnia before the Official Plan Amendment is adopted and the Zoning By-law is passed, the person or public body is not entitled to appeal the decisions.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Sarnia before the Official Plan Amendment is adopted and the Zoning By-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
