TAKE NOTICE that the City of Sarnia has received complete applications for a proposed Draft Plan of Condominium (CDS1-2024) and Zoning By-Law Amendment (1-2024) pursuant to Sections 51(17) and 51(19.1) of the Planning Act, as per Section 9(2) of the Condominium Act and in accordance with Section 34 of the Planning Act.

AND TAKE NOTICE that the Council of the Corporation of the City of Sarnia will hold a Public Meeting regarding Zoning By-Law Amendment 1-2024 on September 30, 2024, during its regular Council Meeting commencing at 1:00 p.m. at City Hall, 255 Christina Street North, City of Sarnia, ON, N7T 7N2, under Section 34 of the Planning Act, R.S.O., 1990, as amended.

THE LAND SUBJECT to the proposed applications are described as Blocks 58 and 59, Plan 769 and are located at the northeast and northwest corners of Confederation Line and Ronald Bloore Drive, City of Sarnia.

THE PURPOSE AND EFFECT of the proposed applications are:

a) Application for Draft Plan of Vacant Land Condominium (CDS1-2024)

To establish forty-two (42) dwelling units (comprising 12 semi-detached units and 6 multiple attached units in Block 58 and 24 semi-detached units in Block 59) and common elements for the proposed development. The common elements will include private access driveway and servicing etc., for the dwellings

b) Application for Zoning By-law Amendment (1-2024-85 of 2002)

To replace the existing “Urban Residential 4-15 (H) (UR4-15(H)) Site Specific Zone” with a new “Urban Residential (UR4-XX) Site Specific Zone” that will more appropriately reflect the proposed development. Changes proposed relate to reductions in front yard depth, rear yard depth and the minimum interior side yard setback, an increase in the maximum lot coverage as well as establishing side yard setbacks for the semi-detached dwellings proposed to be located adjacent to the north and south property lines of the Community Lands area.

If you wish to be notified of Council’s decision on the above application(s), you must make a written request to the City Clerk either by email, in person or mail as listed above.

Appeal Information

If a person or public body would otherwise have an ability to appeal the decision of the City of Sarnia to the Ontario Land Tribunal (OLT) but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Sarnia before the Zoning By-law is passed, or before the City gives or refuses to give approval to the plan of condominium, the person or public body is not entitled to appeal the decisions.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the City of Sarnia before the Zoning By-law is passed, or before the City gives or refuses to give approval to the plan of condominium, the person or public body may not be added as a party to the hearing of an appeal before the Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
