TAKE NOTICE that pursuant to Sections 34 and 36 (4) of the Planning Act, the Corporation of the City of Sarnia has received Zoning By-law Amendment Application No. 2-2024 from Heritage Park Estates Inc. (Frank Iacobelli) requesting the removal of a holding (H) symbol.

AND TAKE NOTICE that the Council of the Corporation of the City of Sarnia intends to pass the amending by-law on September 30, 2024, during its regular Council Meeting commencing at 1:00 p.m. at City Hall, 255 Christina Street North, City of Sarnia, ON, N7T 7N2, under Section 36 of the Planning Act, R.S.O., 1990, as amended.

Purpose and Effect of the Application:

The subject property is currently zoned “Urban Residential 4-15 (H) (UR4-15(H)) Site Specific Zone” to permit forty-four (44) multiple-attached dwelling units within a vacant plan of condominium. The holding Symbol (H) may only be removed when the following conditions have been fulfilled to the satisfaction of the City:

  1. That the sanitary sewer and pumping station capacity to fully service the lands with the proposed increase in density be confirmed through an analysis of the existing and future capacity allocations.
  2. That the stormwater management infrastructure and pond capacity to fully service the lands with the proposed increase in density be confirmed through analysis of the existing and future capacity allocations.

The property owner has now submitted the required studies/reports and will enter into a site plan agreement to the satisfaction of the City for the development of these lands.

Description and Location of Subject Land:

The subject land is approximately 1.88 ha (4.65 ac) in area and located on the north side of Confederation Line, at the intersection of Confederation Line and Ronald Bloore Drive. The lands are legally described as PLAN 769 BLK 58 and BLK 59, City of Sarnia.

Other Information:

The removal of the holding zone would allow for the developer to proceed with the development of the lands in accordance with Draft Plan of Condominium Application File No: CDS1 – 2024 and Zoning By-Law Amendment Application File No: (1-2024) for 42 dwelling units on private streets.

Appeal Rights

With respect to the removal of a holding (H) symbol, the Planning Act only accords appeal rights to the owner of the subject lands; as such there are no third-party rights of appeal for its removal thereof.
