Please be advised that Public Hearings of Sarnia City Council will be held on Monday, November 18, 2024, at 1:00 pm to consider the following planning applications:
Zoning By-law Amendment (ZBA) No. 06-2024-85 of 2002 for the property located at 799 and 811 London Road as shown on Area Map 1.

THE PURPOSE AND EFFECT of Zoning By-law Amendment No. 6-2024 is to change the zoning of the:
- 799 London Road property from an “Urban Residential 1 (UR1) Zone” to an “Urban Residential 5 (UR5-34(34) Site-specific Zone”; and
- 811 London Road property from a “Local Commercial 1 (LC1-13) Site Zone” to an “Urban Residential 5-34 (UR5-34) Site-specific Zone”.
The Applicant is also requesting that the uses presently permitted in the “Local Commercial 1-13 (LC1-13) Site-specific Zone” be retained as permitted uses in the new proposed UR5-34 site-specific zone.
The proposed permitted uses of the combined two sites are Accessory uses and buildings, Apartment dwellings, Converted dwellings, Group homes, Homes for the aged, Lawfully existing dwellings, Nursing homes, Retirement homes, Rooming or boarding house, Women’s shelters, along with the uses permitted in the LC1-13 zone which are Day nurseries, Medical centre/clinics, Community Centre and Transitional housing.
The proposed zoning changes are to permit the development of two new residential apartment buildings up to a maximum of 20.0 metres in height (6-Storeys).
Zoning By-law Amendment (ZBA) No. 07-2024-85 of 2002 for the vacant parcel of land located between 463 Kathleen Avenue and 499 Kathleen Avenue and described as Lots 19 to 23, Part Lot 24, and Part of Christy Street on Registered Plan 299 as shown on Area Map 2.

THE PURPOSE AND EFFECT of Zoning By-law Amendment No. 7-2024-85 of 2002 is to change the zoning of the subject lands from “Open Space 1 (OS1) Zone” to “Urban Residential 5 (UR5-35) Site-specific Zone” to permit the development of a 3-storey, 50-unit apartment building which would include 102m2 of office space with kitchen and washroom facilities for the March of Dimes.
Additional Application
The applicants have also submitted a request to deem Lots 19-24 to not be considered lots on a registered plan of subdivision for the purposes of subsection 50(3) of the Planning Act. The purpose of the deeming by-law would be to permit multiple lots to merge “In Title” into one parcel thereby allowing for the construction of the proposed apartment dwelling.

If these applications are approved, development on the above-noted lands would proceed in accordance with approved site plan development control agreements prior to the issuance of building permits.

Planning Act Appeal Information
If a person or public body would otherwise have an ability to appeal the decision of the City of Sarnia to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Sarnia before the Zoning By-Law Amendments are adopted, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Sarnia before the Zoning By-Law Amendments are passed the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
